Terms and Conditions – Keepsake Memory Bears

1. Product Nature and Intended Use:

• Our keepsake memory bears are handcrafted, custom-made items intended for sentimental and display purposes.
• They are NOT toys and are not suitable for children or pets.
• Due to the nature of using pre-owned clothing, these bears are considered fragile and should be handled with care.

2. Materials and Construction:

• We utilize the clothing provided to create the keepsake bears.
• The condition and quality of the finished product are dependent on the condition of the provided clothing.
• Variations in fabric, color, and texture may occur.

3. Care Instructions:

• Due to the delicate nature of the materials, our keepsake memory bears cannot be machine washed.
• Spot cleaning only is recommended if necessary. Use a damp cloth and mild detergent.
• Avoid excessive moisture and direct sunlight to prevent damage.

4. Custom Orders:

• All keepsake memory bears are custom-made to order, based on the customer’s specific instructions and provided clothing.
• Therefore, we do not accept returns or exchanges unless the product is deemed to have a manufacturing defect.
• Any defects must be reported within 7 days of receiving the product.

5. Customer Responsibility:

• The customer is responsible for providing clean and suitable clothing for the keepsake bear.
• We are not responsible for damage or loss of clothing during transit or processing.
• The customer accepts full responsibility for any items sent.
• The customer confirms that they have the right to use the clothing provided.
• The customer is responsible for providing accurate information regarding their order.
• For weighted bears, the customer must provide accurate baby birth weight information.

6. Payment and Processing:

• Full payment is required before processing of the order begins.
• Processing times may vary and will be communicated to the customer upon order confirmation.
• We reserve the right to refuse any order.

7. Shipping and Delivery:

• We are not responsible for delays or damage caused by shipping carriers.
• Delivery times are estimates and may vary.

8. Intellectual Property:

• All designs are the intellectual property of Memory Bears NZ.
• Customers may not reproduce or distribute our designs.

9. Limitation of Liability:

• We are not liable for any direct, indirect, or consequential damages arising from the use of our Keepsake Memory Bears.
• Our liability is limited to the cost of the product.

10. Amendments:

• We reserve the right to amend these terms and conditions at any time without prior notice.
